Why Are the Pogues in Jail in Outer Banks Season 5?

The jail scenes in Outer Banks Season 5 are not simply the police finally catching up with Pope. Pre-release footage shown at Netflix’s 2026 Upfront presentation reportedly places the Pogues in custody in Europe, where they attend a hearing before being extradited and separated. John B, Sarah, Kiara and Pope are sent back toward the Outer Banks, while Cleo is sent to the Bahamas. Pope then faces a second and more personal legal problem when he returns home: the unresolved felony case from Season 4 after he attacked a police officer, accepted an ankle monitor and later cut it off to join the Pogues’ trip to Morocco.

Spoiler Alert

The Season 5 jail is apparently in Europe

Netflix’s public first-look photographs deliberately showed the Pogues behind bars without explaining exactly what they had done. Tudum even teased viewers by asking why the group was in jail and why, for some of them, it was not their first time in custody. Additional footage screened at Netflix’s Upfront presentation provided more context, reportedly showing the Pogues detained and attending a hearing in a European setting.

Reporting on the footage places those scenes early in Season 5. Promotional photographs are said to show the group in Europe in Episode 2 and surrendering or behind bars in Episode 3, followed by their return to the Outer Banks during the same episode. The material does not yet establish every charge that leads to their detention, so it would be premature to claim one specific crime causes the European arrest. What is clearer is that this is separate from Pope’s older legal case in North Carolina.

Their pursuit of Groff puts them in legal trouble again

Season 5 begins with the Pogues stranded after JJ’s death and still intent on catching Chandler Groff. Netflix’s released opening minutes show them trying to reach Lisbon because Groff is preparing to sell the Blue Crown to a buyer in Portugal. Their plan involves paying a smuggler to transport them, only for the group to discover that the operation is much more dangerous than expected.

That context gives the European custody scenes a logical place in the story even though Netflix has not yet revealed the exact offense. These are already fugitives and treasure hunters moving internationally through unofficial channels while chasing a wanted killer and a valuable artifact. The Upfront footage reportedly ends this European stretch with authorities extraditing and separating them. Exactly what triggers the arrest should remain described as unconfirmed until Season 5 supplies the missing scene.

Pope already had a felony case waiting for him

Pope’s situation is much easier to explain because it comes directly from Season 4. He faces felony charges after tackling a police officer while trying to protect JJ. The legal consequences become serious enough that joining the Marines is offered as his route away from prison. Instead, Pope panics on his way to enlist, returns to his friends and ultimately removes the electronic monitor attached to his ankle.

He then leaves the country with the Pogues for Morocco. That decision does not erase the original charge, and the show’s creators have already indicated that the consequences of Pope’s increasingly violent decisions would continue into the final season. Reporting on Netflix’s Season 5 footage says those consequences arrive quickly after he gets home, when Pope is served with an arraignment notice on Kildare Island.

Why are several Pogues jailed if Pope is the one with charges?

Because the jail image appears to come from the group’s European adventure rather than Pope’s North Carolina case. This is the easiest part of the promotional material to misread. Pope has a specific unresolved felony charge from Season 4, but the Season 5 first-look photos place several Pogues together behind bars before their return to Kildare.

That means viewers should not assume John B, Sarah, Kiara and Cleo are jailed because they somehow inherit Pope’s charge. The reported timeline instead points to a new incident connected with their pursuit of Groff abroad. After that detention is resolved through extradition, Pope immediately has to confront the separate legal mess he left behind. Season 5 is effectively stacking one arrest problem on top of another.

Cleo’s separation has a familiar Outer Banks echo

The reported extradition also splits the Pogues up. John B, Sarah, Kiara and Pope return toward Kildare, while Cleo is sent to the Bahamas. That resembles an old Outer Banks habit of scattering the group geographically before bringing them back together, particularly the Season 2 storyline in which different members of the crew were separated across borders.

Cleo’s situation is especially notable because she originally entered the story in Nassau before eventually becoming one of the core Pogues. Netflix has not yet publicly explained how quickly she reconnects with the others or precisely what immigration or legal circumstances send her to the Bahamas. The early separation therefore tells us where the characters go, but not every procedural detail behind the decision. That distinction is worth keeping clear until the episodes provide the full sequence.

Pope may still face the most serious consequences

The European jail sequence looks temporary, while Pope’s Season 4 case has the potential to follow him much longer. He did not simply miss an appointment or leave town unexpectedly. He was already facing a felony charge, was electronically monitored, abandoned the arrangement that could have kept him out of prison and then left the country.

Pope also returns from Morocco carrying another trauma after shooting Lightner while protecting Cleo. Netflix’s Season 5 opening describes him as dealing with PTSD from that killing, while the creators previously said the ramifications of Pope taking a life would be part of his story going forward. His Season 5 arc therefore begins with both legal and psychological consequences catching up with the character who was once the most careful member of the group.

The clearest answer, then, is that there are two different custody stories. The Pogues are jailed together during the European leg of their hunt for Groff, although the exact incident causing that detention has not yet been fully revealed publicly. Pope then returns home to face the felony case and broken ankle-monitor conditions he left behind in Season 4. Outer Banks has always allowed its characters to outrun consequences for a surprising amount of time, but the final season appears ready to make at least some of those consequences catch up with them.
